These General Terms and Conditions are an agreement between the two parties:

Any person wishing to make a purchase (hereinafter, the "Customer") via the Seller's website: www.prophetieparfum.com (hereinafter, the "Site").

These General Conditions of Sale may be modified at any time and without notice by the Seller and the applicable General Conditions of Sale will be those in force on the date of your order. Where applicable, these General Terms and Conditions take precedence over any other version or any other contractual document.

ARTICLE 1 - PRODUCTS AND PRICES

  1. PRODUCT AVAILABILITY

Our products are valid and available as long as they are visible on our Site, while stocks last. We inform you of the availability of the products sold on the site at the time of validation of the order.

If, despite our vigilance, the products ordered are unavailable, we will inform you by email as soon as possible, and will offer you either to order another product on the site as a replacement, or to cancel your order. If you choose to cancel your order, you will be refunded immediately if your bank account has already been debited and no later than 30 days following payment of the amount transferred.

The products comply with the regulations in force relating to personal safety and health and consumer protection at the time of their placing on the market. The products comply with the requirements of French law in force at the time of their placing on the market.

Our product range may be modified at any time by Propheti.e. The main information and characteristics of the products are present on the Site and may be regularly updated.

  1. PRICE

The prices of our Products are indicated in Euros, all taxes included (TTC).

In the event of an order to a country other than mainland France, it is your responsibility to pay and cover customs duties or taxes if required.

The payment requested is the total amount of your order, including delivery costs.

We reserve the right to modify the prices of our products at any time and without notice. Products are invoiced based on the prices presented on the site at the time of payment for your order.


ARTICLE 2 - ORDER PROCESS

Process for placing an order on our Site:

  1. Find out about the Products on our Site by reading the descriptions
  2. Select the products you want with the desired quantities
  3. Add them to your cart
  4. Fill in the contact details and other customer information by following the instructions or by creating your customer account
  5. Choose a delivery method
  6. Choose a payment method


- It is up to the Customer to check the details of their order: content, quantity, the total amount (including shipping costs depending on the delivery method you have chosen) and to correct any errors before confirming their order.

- Propheti.e will archive orders and order confirmations on a reliable and durable medium constituting a faithful copy of proof of communications, orders, payments and transactions between the Seller and the Customer

- Any sale will be made within the limits of available stocks (the Customer will be informed of any unavailability of the ordered product)

- Confirmation of the order implies acceptance of all the provisions of these General Terms and Conditions and constitutes proof of the existence of the sales contract.

- Propheti.e is not responsible for incorrect delivery information (missing or incomplete address, name, postal code)


ARTICLE 3 - PAYMENT OF THE ORDER

All orders are payable in euros on the site.

Any order placed on the Site must be immediately paid upon validation of the order. We accept payments by bank cards (Visa, Euro card, MasterCard, American Express) or PayPal. Your credit card payment data is protected and encrypted by our service provider.

By providing your credit card information, you authorize us to debit your credit card for the amount corresponding to the tax-inclusive price of your order.

You confirm that you are the holder of the charged credit card and that the name on the credit card is yours.

If the total price including tax of the order is not debited, we reserve the right to cancel the order. You will need to re-place your order with a valid payment method.

The banking transaction is secure and, in no way, does the Seller keep any banking information about the Customer.

ARTICLE 4 - DELIVERY AND SHIPPING

The Products presented on the Site are available for sale online. We ship worldwide.

In mainland France 🇫🇷:

The indicative delivery prices are:

  • From 50€ purchase: FREE - Delivery either by La Poste or by Mondial Relay depending on your choice
  • For an order of less than €50 purchase: €2.90 - Delivery by La Poste via tracked letter

In Europe :

  • From 150€ purchase: FREE
  • For an order between €50 and €150: €11
  • For an order of less than 50€ purchase: 5€

For the rest of the world:

  • From 250€ purchase: FREE
  • For an order between €50 and €250: €28
  • For an order of less than 50€ purchase: 10€

After confirmation of your order by e-mail and receipt of payment for your order, it will be sent according to the delivery method chosen during the order process.

Delivery times vary depending on the processing times of your order and delivery times of the carrier.

Indicative shipping times are:

    • Preparation :

    2 to 4 working days before shipping the package (except exceptional closure)

    • Delivery :

    -> Metropolitan France, Monaco and Andorra: 2 to 5 working days from the shipping date

    -> Other destinations: 3 to 20 business days from shipping date

    1. DELIVERY PROBLEMS AND DELAYS

    When the package is shipped, we will email you the corresponding tracking number.
    From departure to arrival, you can track your package by indicating its tracking number on the carrier's website.

    Delivery delays are the responsibility of the carriers and are not the responsibility of the Seller.

    In the event of a delay of more than 7 days, we invite you to contact us by email at the address: contact@prophetieparfum.com, we will do our best to find a solution.

    Upon receipt of the package, we invite you to check the overall status of your order and its contents. For any comments regarding the status of your order upon receipt of your package, please notify us by email at contact@prophetieparfum.com upon receipt, attaching the necessary photos.

    If the product arrives damaged, opened, broken, damaged, we will do our best to find a solution: either a refund within a maximum period of thirty days from the date on which the damage was noted, or sending a a new product at our expense within a maximum of seven days.

    Be sure to complete all delivery fields when placing your order. If inadvertently, the address indicated when placing the order is missing, incomplete, or false and the package is returned to us, we will be obliged to reimburse the order with the exception of shipping costs (even those included in the price).

    ARTICLE 5 – WITHDRAWAL

    1. WITHDRAWAL

    Thank you for choosing Propheti.e for your purchases. Our priority is to provide you with high quality products and services, but we understand that sometimes circumstances may arise that may cause you to request a refund. Below are the refund conditions and procedures.

    Reimbursement eligibility:

    • Products must be returned in their original condition, without signs of wear, damage or improper use.
    • To be eligible for reimbursement, you must provide valid proof of purchase, such as a receipt or invoice.
    • Refund requests must be submitted within 30 days of the date of purchase.

    Non-refundable products:

    Some items are not eligible for refund unless defective:

    • Perishable or consumable products, such as our perfumes if they have been used: a visual inspection will be carried out and if the perfume has been used we can object to reimbursement;
    • The samples
    • Sale items
    • Products damaged by misuse, neglect, accident or modification.

    Reimbursement request process:

    • Our team will review your request and provide you with further instructions on the returns procedure.
    • Please provide a detailed description of the problem or reason for the refund, along with proof of purchase.
    1. BACK

    Returns must be made within fourteen days following the date of receipt of your withdrawal. The products must be returned in their original, complete, unopened condition allowing them to be re-marketed, in new condition. Any opened or damaged product will not be taken back or refunded.

    If the return is accepted, we will refund all payments received. Either by re-crediting the Customer's bank card or Paypal account, or by bank transfer depending on the method of payment for the order.

    We reserve the right to defer reimbursement until receipt and verification of the returned products.

    Return costs are your responsibility, except in the case of a defective product.

    1. EXCHANGE

    Exchange of Propheti.e products is not possible.

    In the event of dissatisfaction with a product, you must request a refund of the product (on condition that the product is returned new, unopened and in its original condition) and thus place a new order.

    Sample discovery bags and gift bags are neither exchanged nor refunded, except in the case of a defective product.



    ARTICLE 6 – GUARANTEES

    All our products are covered by the legal guarantee if the product has been used under normal conditions of use.

    - Article L211-4 of the Consumer Code: the Seller is required to deliver a product that complies with the contract and is responsible for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.

    - Article L211-5 of the French Consumer Code: To comply with the contract, the good must: Be suitable for the use usually expected of a similar good and, where applicable: Correspond to the description given by the Seller and possess the qualities that the latter presented to the Client in the form of a sample or model; Present the qualities that a buyer can legitimately expect in view of the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling; Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the Seller, brought to the attention of the Seller and which the latter has accepted.

    - Article L211-9: In the event of a lack of conformity, the Customer chooses between repair or replacement of the goods. However, the Seller cannot proceed according to the buyer's choice if this choice results in a clearly disproportionate cost compared to the other method, taking into account the value of the goods or the importance of the defect. In this case, the seller is required to proceed, unless impossible, according to the method not chosen by the Customer.

    - Article L211-10 of the French Consumer Code: If repair and replacement of the goods are impossible, the Customer can either return the goods and have the price refunded, or keep the goods and receive part of the price. The same option is open to him: If the solution requested, proposed or agreed pursuant to article L. 211-9 cannot be implemented within the month following the buyer's complaint; Or if this solution cannot be implemented without major inconvenience for the Customer, taking into account the nature of the goods and the use they are seeking.

    However, the sale cannot be canceled if the lack of conformity is minor.

    - Article L211-11 of the Consumer Code: The application of the provisions of articles L. 211-9 and L. 211-10 is free for the Customer.

    - Article L211-12 of the Consumer Code: Action resulting from lack of conformity is prescribed two years from delivery of the good.

    - Article 1641 of the Civil Code: The Seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the Customer would not have it not acquired, or would have given only a lower price, if he had known them.

    - Article 1648, paragraph 1, of the civil code: Action resulting from fatal defects must be brought by the purchaser within two years from the discovery of the defect.


    ARTICLE 7 - INTELLECTUAL PROPERTY

    All elements of the Site: graphic, textual elements, videos, images and products, are the exclusive property of Propheti.e.

    Any reproduction, copy, distribution, modification or use, total or partial, of these Intellectual Property Rights, for any reason whatsoever and on any medium whatsoever, without the express and prior consent of Propheti.e, is strictly prohibited. The same applies to any combination or conjunction with any other brand, symbol, logo and, more generally, any distinctive sign intended to form a composite logo.

    Failure to comply with this obligation constitutes an infringement involving the civil and criminal liability of its author.


    ARTICLE 8 - LIMITATION OF LIABILITY

    We decline all responsibility for the accuracy of the information appearing on our Site and in particular any comments or content posted by third parties.

    Our Site may contain links to other sites and resources belonging to third parties; These links are provided for informational purposes only. We do not control the content of those sites or resources and we accept no responsibility for their content or for any loss or damage that may arise from their use.

    We decline all liability in the event of direct, indirect or consequential loss or damage suffered by any User in connection with our Site or its use, an inability to use it, or the consequences of the use of our Site, websites which may be linked to it and any information published on our Site.

    We also decline any responsibility in the event of disruptions to the Site, computer errors or on the Site, sending of emails to an incorrect address or any other malfunction or interruption linked to the Internet.

    We decline all responsibility regarding the return of an order placed due to an error in delivery information on the part of the Customer.

    The products offered comply with current French and European legislation and the standards applicable in France and Europe. Propheti.e is in no way responsible for non-compliance with the legislation of the country where the product is delivered (for example in the event of a product being banned). It is your responsibility to check with local authorities the possible implications of the importation and use of the products you are considering ordering.

    The photographs appearing on the site are not contractual and may have been modified. Propheti.e cannot be held responsible for the inaccuracy of photographs or graphic representations appearing on the site. We invite you to refer to the exact description of each product to find out its precise characteristics.


    ARTICLE 9 - FORCE MAJEURE

    All irresistible facts or circumstances, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts, will be considered as force majeure: in the event of disruption, flood, fire or strike, including postal services and means of transport or communication, shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers.

    Consequently, Propheti.e will not be liable for direct or indirect damage linked to such events beyond its control.

    In the event of force majeure, we will inform you as soon as possible and will make every effort to keep you informed of developments.

    When the suspension of the performance of Propheti.e's obligations continues for a period of more than ninety (90) days, you have the right to terminate the current order and Propheti.e will then reimburse you in full of the order.


    ARTICLE 10 - RIGHTS AND DISPUTES

    These General Terms and Conditions are subject to French law.

    These General Terms and Conditions are written in French. If they are translated into another language, only the French text will be authentic in the event of a dispute.

    In the event of a dispute, the customer is informed that he can have recourse to the consumer mediation procedure under the conditions provided for in Title I of Book VI of the French Consumer Code.

    In accordance with Article 14 of Regulation (EU) No. 524/2013, the customer is also informed that the European Commission has set up an online dispute resolution platform, facilitating the independent resolution of online disputes by means of extrajudicial action between consumers and professionals in the European Union: https://webgate.ec.europa.eu/odr/

    Disputes which cannot be resolved amicably will be brought before the competent French courts.


    ARTICLE 11 - PERSONAL DATA

    The Seller informs the Customer that his personal data is recorded and that the Seller has taken preliminary steps with the CNIL concerning the processing of this data, in accordance with the provisions of the Data Protection Act No. 78-17 of January 6 1978.

    The Customer is informed that his data is subject to processing allowing the Seller to be able to offer him the various services offered by the Site. This data is also necessary for the management of your order and our relations with customers.

    The personal data transmitted by the Customer are not communicated by the Seller to third parties and are not used for commercial prospecting purposes.
